Canada Debate Reaction
I watched the Canadian Party Leader's debate last night on C-SPAN2, and I would have posted a reaction (besides the fact that I think Harper is brilliant, and the kind of conservative we need here), but I know Jess was going to (and has done), a better job than I ever could. She also includes an explanation of the "Nonwithstanding Clause" and how Alito ties in:
The timing for Martin's suggestion could not be worse, considering that yesterday was also the beginning of Samuel Alito's confirmation hearings. If ever there was an example as to why Canadians should want to keep the clause, it would be Ted Kennedy's blathering on and on about Alito's record regarding abortion (which I note was his record as an attorney, not as a judge). In other words, Paul Martin wants to remove the one safeguard Canadians have from an activist judiciary, one that is (or is not, depending on your p.o.v.) created in order to see that what cannot be accomplished through legislation can be accomplished by other means, namely court rulings.
